This Privacy Policy describes how Ascension Capital (“we,” “us,” or “our”) collects, uses, discloses, and protects personal information in connection with our website, our borrower portal, and the owner-financed land contracts we originate and service.
Information we collect
We collect the following categories of information:
- Identity and contact information — name, mailing address, email address, and phone number, collected when you enter into a land contract with us or use the borrower portal.
- Loan and transaction information — your contract terms, payment history, account balance, escrow activity, and related servicing records.
- Payment information — bank account or payment card details you provide to make payments. Payment credentials are collected and stored by our payment processor, Stripe; we do not store full bank account or card numbers on our own systems.
- Sign-in and device information — one-time sign-in codes sent to your phone or email, session cookies, and basic log data (such as IP address and browser type) generated when you use the portal.
How we use information
We use personal information to:
- Originate and service your land contract, including collecting and applying payments, maintaining payment records, and providing statements;
- Operate the borrower portal, verify your identity at sign-in, and secure your account;
- Communicate with you about your account, including payment reminders, receipts, and servicing notices by mail, email, or text message;
- Comply with legal, tax, and regulatory obligations (for example, issuing IRS Form 1098 where required); and
- Prevent fraud and enforce our agreements.
We do not sell personal information, and we do not use it for third-party advertising.
Who we disclose information to, and how
We disclose personal information only as needed to run our business, to the following categories of recipients:
- Payment processing — Stripe, Inc. processes payments on our behalf. Information is transmitted to Stripe electronically over encrypted connections. Stripe’s handling of your information is described in its own privacy policy.
- Service providers — companies that host our systems and databases, deliver email and text messages, and provide similar infrastructure services under agreements that restrict their use of your information to providing those services. Disclosure occurs electronically over encrypted connections.
- Professional advisers — our accountants, attorneys, and auditors, where necessary for tax preparation, legal advice, or compliance.
- Legal and safety — courts, regulators, or law enforcement where disclosure is required by law, subpoena, or legal process, or where necessary to enforce our contracts or protect our rights. Disclosure is made by the method the request or applicable law requires.
- Business transfers — if a loan or our business is sold or transferred, servicing records may transfer to the successor, which must handle them consistent with this policy and applicable law.
How we protect information
We maintain administrative, technical, and physical safeguards designed to protect personal information, including: encryption of data in transit (TLS/HTTPS) across the website, borrower portal, and connections to our service providers; encryption of data at rest in our hosted databases; role-based access controls that limit account data to personnel who need it for servicing; authentication by one-time codes rather than stored passwords for borrowers; and logging of account activity. No system is perfectly secure, but we take the security of your financial information seriously and review our practices as our business grows.
Data retention
We retain loan and payment records for the life of your contract and for the period required by tax, accounting, and legal obligations after it ends. Sign-in codes expire within minutes of issuance.
Cookies
The borrower portal uses cookies solely to keep you signed in. We do not use advertising or cross-site tracking cookies.
Your choices
You may review your account information in the borrower portal at any time, and may contact us to correct inaccurate information. Servicing communications (such as payment notices) are a condition of your contract and cannot be opted out of while your loan is active.
Children
Our services are for adults entering land contracts. We do not knowingly collect information from children under 13.
Changes to this policy
If we make material changes to this policy, we will post the updated version on this page with a new effective date and, where appropriate, notify borrowers directly.
